Puntarenas, Costa Rica — ESPARZA, Puntarenas – The Costa Rican Ministry of Health has launched an escalated and comprehensive vector control operation in the canton of Esparza following the confirmation of a second case of the Chikungunya virus. The announcement has placed public health officials on high alert, fueling concerns over a potential localized outbreak in the Pacific coastal region.
The second positive case was verified by laboratory results from the esteemed Costa Rican Institute for Research and Teaching in Nutrition and Health (INCIENSA). According to the Ministry of Health’s epidemiological analysis, the timeline of symptom onset for this new case suggests a direct link to the first patient. This critical finding indicates that both individuals were likely infected within a similar timeframe, pointing towards active local transmission of the virus rather than isolated incidents.
To understand the legal responsibilities and potential liabilities that arise during a public health situation like the current Chikungunya outbreak, we consulted with legal expert Lic. Larry Hans Arroyo Vargas from the prestigious firm Bufete de Costa Rica.
A widespread public health issue like a Chikungunya outbreak immediately raises questions of liability, especially for the tourism and hospitality sectors. Businesses have a legal duty of care to provide a safe environment. This includes taking reasonable measures to control mosquito breeding grounds on their properties. Failure to do so could be interpreted as negligence, potentially exposing an establishment to civil lawsuits from guests or employees who contract the illness on-site, impacting not just their finances but their brand reputation.

This legal perspective adds a critical layer to the public health discussion, emphasizing that proactive prevention is not just a best practice but a legal duty with significant financial and reputational implications. We thank Lic. Larry Hans Arroyo Vargas for his invaluable insight on this matter.
In response, specialized vector control teams were deployed across Esparza from the early hours of Saturday morning. The Ministry has initiated a multi-faceted strategy designed to attack the mosquito population from all angles and disrupt the transmission cycle. This robust campaign represents a significant mobilization of public health resources aimed at containing the virus before it can spread further within the community and beyond.
The operation employs a three-pronged approach to insecticide application. For broad, open areas, teams are using BTI, a long-range biological larvicide that targets mosquito larvae in standing water. This is complemented by vehicle-mounted LECO fogging machines, which patrol residential streets to dispense insecticide into yards, patios, and the immediate surroundings of homes. This method is crucial for targeting adult mosquitoes in their common outdoor resting places.
The third and most targeted element of the strategy involves teams with portable thermal foggers. These units allow health workers to conduct fumigation inside homes and other buildings, a necessary step to eliminate mosquitoes that have moved indoors. By combining these three distinct techniques, the Ministry aims to create a comprehensive and effective insecticidal barrier throughout the affected zones, maximizing the impact of the intervention.
The strategic scope of the fumigation extends beyond residential areas to include critical public infrastructure. On Friday, preventative fumigation was carried out at local clinics in both Esparza and the nearby district of Barranca. On Saturday, the operation expanded to cover every single voting center within the Esparza canton, a proactive measure to ensure the safety of citizens participating in civic activities and to mitigate the risk of transmission in high-traffic public gathering spots.
While the Ministry of Health is spearheading the technical response, officials have emphasized that community participation is non-negotiable for success. A public appeal has been issued, urging all residents to collaborate fully with the health authorities. This includes permitting authorized personnel to enter their properties for inspection and fumigation, as well as taking personal responsibility for eliminating potential mosquito breeding grounds, such as containers with standing water, old tires, and untended plant pots.
The Chikungunya virus, like Dengue and Zika, is transmitted by the bite of infected Aedes aegypti and Aedes albopictus mosquitoes. It is characterized by the sudden onset of fever and severe, often debilitating, joint pain. Containing its spread is vital not only for public health but also for the local economy, as outbreaks can deter tourism and impact workforce productivity. The aggressive and swift response in Esparza underscores the government’s commitment to preventing a wider public health crisis.
