This protracted legal saga began in 2012 when lawyer Didier Carranza filed a complaint against the Bar Association on behalf of fellow attorney León Montoya. Montoya’s request for a pension, based on a law that created a specific legal stamp to finance such a fund, had been rejected. The lawsuit argued that the revenue from the “Timbre del Colegio de Abogados” was explicitly intended to establish a pension and retirement fund, as well as to support the institution’s operational costs.
In 2013, the Administrative Litigation Court sided with Montoya, condemning the Bar Association and ordering it to create and implement the regulations for the pension plan. Despite this definitive ruling, the matter has remained unresolved, fostering uncertainty and frustration among members about the status and current balance of the designated fund. The recent ultimatum represents the court’s exhaustion with the lack of progress.
The financial framework for the fund is outlined in Article 3 of Law 3245. It stipulates that the pension system is to be financed through 13% of the income the Bar Association receives from the sale of the legal stamps, supplemented by a direct contribution from its members. Upon incorporation, all lawyers are automatically affiliated with the fund.
For the attorneys who have championed this cause for over a decade, the court’s final order is a monumental victory. Lawyer Didier Carranza, who has been central to the legal fight since its inception, highlighted the gravity of the mandate.
This order is now final; within the three-month period, the Bar Association is obligated to comply with this judicial mandate to avoid incurring disobedience and other possible crimes. This confirms that we have finally reached the end of an enormous ordeal where the judge in charge of this execution did not want to execute this sentence since the 2013 ruling, when it became final.
