The judge at the time prioritized the potential disruption to public health services that suspending the contracts would cause.

We are dealing with a contract for the provision of services in a considerable number of Ebáis and Health Areas by the awarded cooperatives and associations, which is already in execution; therefore, granting the request would imply that the CCSS must resume the provision of the awarded services on its own, which entails a transition process that would undoubtedly affect the continuity of the awarded health services, which would directly affect the right to health and the timely care of the people assigned to the health areas that were the object of this contract.

Despite the rejected injunction, the CCSS Board of Directors had already suspended the contracts in question approximately five months prior. This suspension, coupled with the judge’s decision, led to the Presidency’s premature declaration of the case’s closure.
