Guanacaste, Costa RicaLIBERIA, Guanacaste – The iconic Condovac La Costa beach club and hotel in Playa Hermosa was the center of a major judicial operation on Tuesday, as agents from the Judicial Investigation Agency (OIJ) and the Liberia Prosecutor’s Office executed a raid amid a sprawling investigation into fraudulent administration. A total of 19 individuals, including the club’s former president, have been named as suspects in a case that alleges years of mismanagement and financial irregularities.

The raid, authorized under case file 25-000020-0283-PE, targeted the hotel’s facilities in Guanacaste as well as the San José office of the former club president, identified by the surnames Rodríguez Rivera, located in Paseo Colón. Officials confirmed the objective was to seize crucial evidence, including accounting records, shareholder registers, and electronic devices, to advance the complex investigation.

The legal action stems from a formal complaint initiated by 22 club members, a group that has since swelled to represent the interests of approximately 250 dissatisfied partners. These members allege a systematic effort by management and the board to operate the club for personal gain, leading to a significant decline in the property’s condition and value. The Public Ministry confirmed the 19 suspects but declined further comment, citing the private nature of the ongoing investigation as stipulated by Article 295 of the Criminal Procedure Code.

The complaint details a series of calculated maneuvers allegedly designed to consolidate power and marginalize dissenting members. One such tactic involved moving shareholder meetings from San José, where many elderly members reside, to Guanacaste. These meetings were scheduled for 7 a.m. on Saturdays, making attendance prohibitively difficult for many.

Another element demonstrating this fraudulent intent is the following: shareholder meetings used to be held in San José, and since the vast majority of members are senior citizens, the Board of Directors, with the complicity of the General Manager, decided to hold them in Guanacaste at seven in the morning for the first call, on a Saturday, where it is less likely that members will arrive.

This strategic relocation, the plaintiffs argue, allowed a small group to control outcomes. The complaint points out that the General Manager and his wife hold over 500 shares combined, giving them a dominant voting bloc in sparsely attended assemblies. The visible consequence of this alleged mismanagement is the resort’s physical state.

Part of the assertion that fraudulent administration exists is the fact that the Club is in a state of total deterioration, lacking maintenance, which shows that the funds, or the few funds that exist, are not being used for the benefit of the club, which is an evident concern for the members.

José Pablo Murillo Quirós, the attorney representing the 250 members, explained that the legal action is a last-ditch effort to save the historic club. He described a leadership structure where certain administrative employees and board members have held their positions for life, altering statutes to benefit themselves at the club’s expense.

This is a complaint filed by several members who are interested in seeing the club recover, in achieving an economic salvation due to inconsistencies they have been able to detect at first glance. The central point being developed in this complaint is that both administrative employees and members have been on the board of directors almost for life, occupying administrative and board positions, and have changed the statutes in order to benefit themselves personally and to the detriment, let’s call it, of the club itself.

Murillo also highlighted major financial red flags, including “million-dollar loans” that were supposedly approved by the assembly for specific improvements to the resort. “The complaint is quite long, but among the most important issues are talks of million-dollar loans where, before the members’ assembly, it was determined that the loans were to make improvements to the club that have not been carried out to this day,” he stated.

Discontent among members of Condovac La Costa, which first opened in 1980, has been simmering for years, escalating after the pandemic. In 2023, the frustration culminated in the formation of the “Grupo de Rescate de Condovac La Costa” (Condovac La Costa Rescue Group). A primary source of their grievance dates back to 2011 with the introduction of an all-inclusive hotel model, which opened the facilities to non-shareholders and, in their view, accelerated the wear and tear on the property while diminishing the quality of service for members.
