While connectivity is crucial for modern society, experts argue that unplanned development is creating a chaotic environment detrimental to cities and citizens.

The proliferation of telecom infrastructure, particularly utility poles, has become a growing issue. EsCiudad, an architectural consulting firm, recently released a guide for local governments on managing technological innovation, highlighting the problems arising from unchecked growth.

The rapid evolution of telecommunications infrastructure presents both opportunities and challenges from a legal perspective. The guide, titled “Guide for Technological Innovation in Local Governments,” examines international best practices and addresses concerns from municipalities grappling with the rapid increase of poles in public spaces. It emphasizes the need for responsible and organized installation to ensure accessibility for people with disabilities, maintain public safety, and avoid obstructing pedestrian mobility.

While Costa Rica’s Law 10216, published in 2022, aimed to regulate infrastructure development, subsequent decrees intended to broaden access have inadvertently fueled unnecessary construction. This has led to the installation of new poles in areas already served by existing infrastructure, contradicting the principle of shared use and user benefit promoted by the law.

Currently, poles are being installed in areas where they are not required because there is already infrastructure available, which goes against the principle of Shared Use and User Benefit established in Law 10216 and the General Telecommunications Law, which promote that several operators use the same infrastructure to avoid duplication of towers in the same place, which generates mobility problems and visual impact to the landscape.

Furthermore, Decree 44335 from the Ministry of Science, Innovation, Technology, and Telecommunications (MICITT) allows for poles exceeding 24 meters in height, making Costa Rica an outlier in Latin America, where the average pole height typically stays below 15 meters. This decree also restricts the ability of local governments to regulate urban planning by prohibiting them from setting technical or zoning criteria related to telecom infrastructure in their regulatory plans.

Another point of contention is the low canon fee for pole installation established by regulation MH-DGT-RES-0010-2024. This incentivizes companies to move infrastructure from private to public spaces, even when unnecessary, impacting municipal revenue. EsCiudad’s guide underscores the disparity between Costa Rica’s low fees, averaging around US$5 per month, and those of other countries in the region.

The “Guide for Technological Innovation in Local Governments” offers valuable support for municipalities navigating the complexities of telecom infrastructure development in Costa Rica. It identifies challenges, highlights opportunities, and promotes responsible planning for the benefit of communities nationwide. The guide was presented to approximately 100 local government leaders in early June at an event coordinated with the Union of Local Governments (UNLG).
