The Tribunal Contencioso Administrativo del Segundo Circuito Judicial de Goicoechea sided with Punta Leona, upholding its property rights and criticizing the municipality’s actions as lacking legal basis.

The dispute centers around access to Playa Blanca and a structure referred to as “the needle,” located at the entrance of the Punta Leona property. The municipality, led by Mayor Francisco González, had verbally threatened to demolish the structure and open a road through the private property. The Tribunal emphasized that there is another access route to Playa Blanca other than the road that runs through the private property, a fact recognized even in a report submitted by the Garabito Municipality itself to the Constitutional Chamber, in process 23-004285-0007-CO, and in a 2023 ruling by that same authority; therefore, there are sufficient grounds to guarantee that the public interest is not affected.
