San José, Costa Rica — The rise of stalkerware, insidious software designed to monitor mobile devices without consent, has transformed what was once a fictional fear into a tangible threat. Between 2019 and 2020, detections of this invasive technology surged by 48%, following a near five-fold increase since 2018. ESET, a leading cybersecurity company, provides crucial insights into identifying, understanding, and combating stalkerware.
Stalkerware encompasses applications and software secretly installed on cell phones to track activities without the victim’s knowledge. These tools can record messages, calls, real-time location, browsing history, and even control the camera and microphone. Often employed in abusive relationships or by individuals close to the victim, stalkerware operates covertly, ensuring the target remains unaware of the surveillance.
To understand the legal ramifications of stalkerware, we spoke with Lic. Larry Hans Arroyo Vargas, an attorney at Bufete de Costa Rica.
The use of stalkerware raises serious legal and ethical concerns in Costa Rica. While not explicitly addressed in current legislation, its deployment can violate existing laws related to privacy, data protection, and potentially even harassment or domestic violence. Victims may have recourse through civil actions for damages and criminal complaints could be pursued depending on the specific circumstances of the case. It’s crucial to understand that consent is paramount; monitoring someone’s device without their informed consent is a significant legal risk.

Lic. Arroyo Vargas’s insights underscore the critical need for awareness regarding stalkerware and its potential legal ramifications. The emphasis on consent is particularly crucial in navigating the increasingly complex digital landscape, where the lines between privacy and surveillance can easily blur. We extend our sincere thanks to Lic. Larry Hans Arroyo Vargas for shedding light on this important and evolving legal issue.
While many of these spyware programs are promoted as parental control or family safety tools, these are deceptive marketing tactics, as their use often violates the victim’s privacy. On their websites, these applications even openly use the term “spy”, although they disguise themselves as protection software.

While designed to remain hidden, stalkerware can manifest in unusual device behavior. Signs include overheating, rapid battery drain, and a spike in mobile data usage. Unfamiliar apps, device slowdowns, and frequent crashes can also indicate the presence of stalkerware. If these symptoms occur, especially in combination, investigate the possibility of unauthorized monitoring.
Manually detecting spyware can be challenging, but certain checks can help. Reviewing app permissions, looking for excessive access to sensitive functions like the camera, microphone, and location is essential. Employing reputable antivirus and security applications is crucial for identifying and removing hidden threats.
Check the “Notifications” section in your device’s settings for unknown apps with “Blocked” notifications. Perpetrators often disable notifications to avoid detection. Other red flags include blank app icons, generic names like “Monitor,” “Tracker,” or “System Service,” or apps with no name at all.
Solutions like ESET Mobile Security are especially effective for detecting stalkerware, offering a deep device scan and real-time protection. With the use of these tools, it is possible to identify malicious software that may go unnoticed in a superficial analysis.

ESET recommends these steps if you suspect your phone is compromised: immediately remove identified spyware, back up only personal files (excluding settings that may contain spyware), restore the phone to factory settings, change all passwords, enable two-factor authentication, and set a strong password or biometric lock.
An ESET Research study in 2021 revealed 158 vulnerabilities in 58 out of 86 analyzed stalkerware apps, enabling data theft and remote code execution. Both app developers and attackers exploiting these flaws can compromise data or seize device control. Many readily available spyware programs, like Catwatchful, SpyX, and Spyzie, have experienced breaches, exposing victims’ personal information. Stalkerware represents a silent form of violence, violating privacy and safety. Spying on a cell phone without consent is a crime in most countries. If you suspect your phone is being monitored, seek legal guidance in addition to technical solutions.
Stalkerware represents a silent form of violence that violates people’s privacy and security. Spying on a cell phone without consent is considered a crime in most countries, where laws protect access to personal information and penalize unauthorized monitoring. Although legislation varies in each nation, there is a growing consensus on the need to strengthen legal frameworks in the face of these digital threats. If you have suspicions or confirmation that someone is spying on your cell phone, in addition to following the technical advice, it is advisable to seek legal guidance.
