San José, Costa Rica — In an increasingly digital world, navigating the online landscape with children presents ongoing challenges. The United Nations reports a concerning statistic: one in twelve children experience some form of online violence. Addressing this critical issue, Costa Rican organization ColibrIA, in partnership with KidsNetGuard, has introduced eContract, a free digital tool designed to empower families to establish clear agreements for technology use at home.

Available at colibria.net, the eContract serves as a customizable guide for parents, caregivers, and children to collaboratively define rules and expectations. Rather than imposing restrictions, it fosters open communication and mutual understanding.

To understand the legal landscape surrounding digital parenting, we spoke with Lic. Larry Hans Arroyo Vargas, an attorney at law from Bufete de Costa Rica.

Digital parenting presents unique challenges to established legal frameworks. While laws regarding child protection and privacy exist, their application to the digital realm requires careful consideration. For instance, monitoring a child’s online activity can be viewed as both a protective measure and a potential invasion of privacy. Striking a balance that respects a child’s developing autonomy while ensuring their safety online requires open communication and awareness of the evolving legal interpretations in this area.

The contract addresses key aspects of digital well-being, including time limits, screen-free zones, responsibilities tied to device use, and scheduled review dates. Families can determine where devices are charged, establish daily screen time limits, or agree on device-free periods, such as during meals.

This collaborative approach aims to preempt conflicts, avoid unilateral impositions, and create a dialogue where children understand the reasoning behind the rules. Herrera emphasizes that the eContract promotes self-regulation, critical thinking, and responsible digital habits. Unlike strict prohibitions, this model emphasizes active listening and negotiation.

The idea is to listen to their needs and reach consensus. This gives them a space where they feel their opinion matters, and we, as adults, teach by example.

Recognizing the evolving needs of children, the eContract is designed to be flexible. Regular reviews are encouraged, allowing adjustments as children grow and their academic or social demands change. The initiative also stresses consistency in digital parenting – rules established for children should apply to adults as well. This models self-control and reinforces the importance of the agreed-upon guidelines.

Further enhancing this initiative is Luna, a 3D AI-powered digital cybersecurity ambassador. Luna provides interactive advice, educational capsules, and encourages families to sign the eContract, reinforcing prevention through daily practice. Herrera reminds us that online risks aren’t always obvious, and adults are often unaware of what happens online. The eContract offers a valuable tool for families to proactively address these challenges and foster a safer digital environment for children.
