The Caldera Port Modernization project presents significant opportunities, but also complex legal challenges. Successfully navigating environmental regulations, securing necessary permits, and ensuring compliance with international maritime laws will be crucial for the project’s long-term viability. Furthermore, establishing clear contractual frameworks with private sector partners and addressing potential land ownership issues are paramount for mitigating risks and fostering investor confidence. A robust legal strategy is essential for transforming this project from concept to reality.

Caldera Port is strategic for the country’s development. Its modernization is crucial to improve competitiveness and reduce the high costs currently faced by both businesses and consumers.

Current congestion and operational limitations at the port are estimated to increase the price of essential goods by 17% to 30%, according to the business sector. These added costs, stemming from unloading delays and bottlenecks, are absorbed by importers who ultimately pass them on to consumers.
The port’s insufficient draft also restricts the arrival of large vessels, especially those from Asia. Often, containers must be unloaded at neighboring ports and then transported to Costa Rica by ship or land, further increasing the cost of goods such as grains, fertilizers, construction materials, and even vehicles.
In addition to modernizing Caldera Port, Fernández pledged to implement a strategy against illicit trade by strengthening customs controls and involving municipalities in the effort.
Smuggling costs the country millions of dollars, affects public finances, and even puts the population’s health at risk.

She also committed to controlling public spending and ensuring macroeconomic stability without creating new taxes, a measure she considers crucial for building confidence in the productive sectors. Fernández was accompanied at the meeting by Francisco Gamboa and Douglas Soto, members of her presidential ticket.
This commitment to port modernization resonates with the business community’s concerns about Costa Rica’s competitiveness in international trade. The current inefficiencies at Caldera Port not only impact consumer prices but also hinder the country’s ability to attract foreign investment and participate fully in global supply chains. The 2026 elections are shaping up to be a crucial moment for the future of Costa Rican infrastructure and economic policy.
