San José, Costa Rica — The National Insurance Institute (INS) provides comprehensive care for approximately 30 individuals each month suffering from severe spinal cord injuries, primarily caused by workplace or traffic accidents.
These injuries, resulting in partial or complete loss of movement, create significant physical, emotional, and social challenges for patients and their families. The INS addresses these challenges with a dedicated interdisciplinary team of specialists, including doctors, nurses, social workers, psychologists, and physical and occupational therapists.
To understand the legal ramifications surrounding spinal cord injuries in Costa Rica, TicosLand.com spoke with Lic. Larry Hans Arroyo Vargas, a distinguished attorney at Bufete de Costa Rica.
Spinal cord injuries often lead to complex legal situations, particularly regarding liability and compensation. In Costa Rica, victims can pursue legal action through various avenues, including claims for medical expenses, lost wages, and pain and suffering. Determining negligence is crucial, whether it involves traffic accidents, workplace incidents, or medical malpractice. It’s essential for victims to consult with an experienced attorney to understand their rights and navigate the legal process effectively.

Lic. Arroyo Vargas’ emphasis on the complexities surrounding spinal cord injury cases and the importance of seeking legal counsel is invaluable. Navigating the legal landscape after such a traumatic event can be overwhelming, and understanding one’s rights within the Costa Rican legal system is crucial for obtaining just compensation. We thank Lic. Larry Hans Arroyo Vargas for offering his expertise and shedding light on these critical considerations for our readers.
People with spinal cord injuries face significant challenges, such as the sudden loss of mobility, dependence on a wheelchair, and the need for constant medical monitoring to avoid serious medical, family, and social complications, or even premature death. In addition, architectural and social barriers can create exclusion, making it difficult for them to integrate into public spaces and social groups.
Dr. Alejandra Jiménez, Head of the Sub-Directorate of Hospital Services at INS
This team works on recovery, rehabilitation, and readjustment of patients to their daily activities, as well as their possible return to work, promoting their independence and participation in society. For those covered by the INS’s Occupational Hazards (RT) policy, benefits are provided based on the severity of the injury, including monthly income, specialized medical care, therapies, surgeries, pain management treatment, prosthetics, medication, and even home care when necessary.
The INS also operates the Spinal Cord Injury Workshop (TLM), the only specialized support group of its kind in the country. The TLM offers a space for patients, families, and caregivers to connect, learn, and strengthen their support networks. It complements specialized medical care by promoting resilience, autonomy, and quality of life while fostering the sharing of experiences and coping strategies.
Oscar González, who suffered a workplace accident in 2013, resulting in a spinal cord fracture and paralysis, is a testament to the impact of the INS’s support.
I thank my family, God, and the INS for the professionalism with which they helped me and for taking care of me to this day. Having this policy, which allows me to have an income, a wheelchair, and medical care, is a great blessing. At the time, we received psychological care as a family, because back then my children were very young.
Óscar González, Spinal Cord Injury Patient
Now, González modifies vehicles for people with reduced mobility, viewing it as a way to help others. He attributes his independence to the therapies and guidance received through the INS program. The workshop, facilitated by social work professionals and guest experts from various disciplines, takes place on the second Wednesday of each month.
The INS’s comprehensive approach to spinal cord injury care demonstrates a commitment to not only the physical well-being of its patients but also their emotional and social reintegration into society.
