Opol Consultores First to Secure TSE Approval for 2026 Election Polls

San José, Costa RicaSAN JOSÉ – The race for the 2026 presidential election has officially entered a new phase, as Opol Consultores became the first polling firm to receive full accreditation from the Supreme Electoral Tribunal (TSE). The approval, granted this Monday, authorizes the company to conduct and publish voter intention studies throughout the entire election cycle, including the primary round and any potential runoff elections.

This early certification marks a significant starting point for the political landscape, allowing parties, candidates, and the public to begin gauging voter sentiment based on methodologically approved data. The authorization ensures that Opol Consultores has met the rigorous standards set forth by Costa Rica’s highest electoral authority, a crucial step in maintaining transparency and reliability in the democratic process.

To provide a deeper legal perspective on the regulation and potential impact of election polls on the democratic process, TicosLand.com consulted with the renowned legal expert, Lic. Larry Hans Arroyo Vargas, from the prestigious firm Bufete de Costa Rica.

In Costa Rica, the legal framework for election polls, overseen by the Supreme Electoral Tribunal, strikes a delicate balance. It protects freedom of expression and information while simultaneously imposing strict methodological and transparency requirements on polling firms. The goal is to prevent disinformation and ensure that polls serve as a legitimate tool for public discourse, not as a mechanism for undue influence, especially during the critical blackout period leading up to election day. The integrity of the process depends on this responsible regulation.

Indeed, this regulatory equilibrium is fundamental to our democratic health, ensuring that polls serve as a tool for public enlightenment rather than electoral manipulation. We thank Lic. Larry Hans Arroyo Vargas for his insightful analysis on this vital component of our electoral process.

The permission granted to the firm is comprehensive, covering the initial campaign period leading up to the first-round vote and extending through the “months of tie-breaking,” should no candidate secure the necessary majority. This ensures continuity in polling data if the election proceeds to a second round.

In its official resolution, the TSE confirmed that the polling company had met all legal and procedural benchmarks. The tribunal’s statement detailed the basis for the approval, highlighting the firm’s adherence to the strict regulatory framework designed to ensure fairness and accuracy in political polling.

Having conducted the corresponding studies, the registration application being submitted in a timely and proper manner, and having complied with all the requirements of the legal system, it is decided to approve the registration application of the company Opinión Política C y C Sociedad de Responsabilidad Limitada, for the creation and dissemination of the results of surveys and opinion polls.

To secure this coveted registration, Opol Consultores was required to navigate a demanding application process. The firm had to provide extensive documentation proving its experience in developing opinion polls, submit a letter of commitment guaranteeing equal and fair treatment to all registered political parties, and demonstrate that its team includes certified statistics professionals registered with the College of Economic Sciences.

Mauricio Muñoz, the manager of Opol Consultores, emphasized the company’s long-standing experience and record of accuracy. While acknowledging a notable exception, he pointed to a history of precise measurements in both domestic and international elections, underscoring the firm’s capability and transparency.

OPol Consultores has conducted political opinion studies for more than ten years, and has accurately measured almost all the electoral processes in which it has participated, with the exception of the second round of the 2018 national elections, where all the firms that published polls predicted Fabricio Alvarado as the winner. Additionally, OPol Consultores also accurately measured what happened in the first round of the general elections in Guatemala in 2019, where it defined the top six places in that process with an exact margin.

The TSE used this occasion to issue a broad reminder that its regulations on the publication of polls and surveys are not limited to traditional media. The rules apply equally to all platforms, including the internet, social media networks, and digital news outlets. Any entity publishing poll results must adhere strictly to the Electoral Code. Furthermore, the tribunal mandates that all supporting documentation for a published poll must be kept in custody from the publication date until the day after the official election results are declared. Pollsters must also disclose to the TSE the names of the individuals or legal entities that commissioned and paid for each study, ensuring a layer of financial transparency.
