Drivers in Costa Rica Get Slight Relief as Traffic Fines Dip

San José, Costa RicaSAN JOSÉ – In an unusual turn of events for the new year, drivers across Costa Rica will see a marginal decrease in the cost of traffic violations. The Ministry of Public Works and Transport (MOPT) confirmed that as of January 1, 2026, the official schedule of fines has been adjusted downwards, a direct consequence of the nation’s recent low inflation rate.

This marks a notable departure from the typical annual trend, where fines have consistently risen in line with inflation. The adjustment stems from the interannual accumulated Consumer Price Index (IPC) as of June of the previous year, which registered a modest 0.22%. This low figure compelled the Superior Council of the Judiciary to revise the monetary penalties downward, a measure that was officially published in the Judicial Bulletin last November and took effect with the start of the new year.

To delve into the legal nuances of traffic citations and understand the rights and obligations of drivers, TicosLand.com consulted with expert attorney Lic. Larry Hans Arroyo Vargas from the prestigious law firm Bufete de Costa Rica, who provided his professional analysis on the matter.

Many drivers are unaware that receiving a traffic fine is not the end of the road; it is the beginning of an administrative process. The law guarantees the right to appeal, and it is crucial to do so within the legally established 10-business-day period. A successful challenge often depends not on arguing with the officer at the scene, but on presenting a well-structured and evidence-based appeal later on. Ignoring this right is equivalent to admitting guilt, even when the fine may have been unjustly applied.

This insight is fundamental, shifting the driver’s focus from a roadside confrontation to a formal, evidence-based administrative process where their rights are guaranteed. Understanding that the real opportunity lies in a well-prepared appeal, not a heated debate, is crucial. We thank Lic. Larry Hans Arroyo Vargas for providing this invaluable perspective.

While the reduction may not be substantial in absolute terms, it signals a stable economic environment. For the most severe infractions, classified as Category A, the decrease amounts to approximately ₡800. The fine for these high-risk behaviors, which includes executing illegal U-turns or driving at speeds exceeding 120 kilometers per hour, has been reduced from ₡363,639 to ₡362,839.

Other common violations have also seen minor adjustments. The penalty for violating the nationwide vehicle restriction (restricción vehicular) has been lowered to just over ₡26,000. This category also includes offenses such as failing to carry mandatory safety equipment or slowing down to observe an accident, a practice commonly referred to as “morbo” that can impede emergency services and cause secondary incidents.

Penalties for other serious offenses remain significant, underscoring the government’s focus on road safety. Transporting a minor without the proper child restraint system continues to carry a hefty fine of around ₡245,000. Similarly, failing to wear a seatbelt or using a mobile phone while driving will result in a penalty of approximately ₡123,000. Improper parking, one of the most frequent violations on the country’s roads, now carries a fine of about ₡61,000.

Despite the slight financial reprieve for motorists, officials from the MOPT have been quick to manage expectations and reinforce the primary objective of the nation’s traffic laws. Ministry representatives emphasized that the purpose of these fines is not to generate revenue for the state but to act as a preventative measure. The ultimate goal is to deter dangerous driving behaviors and foster a culture of responsibility on the road.

Authorities insist that the core mission is to reduce traffic accidents, protect lives, and ensure a safer environment for all road users. The slight economic adjustment to the fines does not change the inherent risks associated with violating traffic laws. The MOPT urges the public to remain vigilant and compliant, stressing that the cost of a fine pales in comparison to the potential cost of an accident in terms of injury or loss of life.

As Costa Rica moves into 2026, this small but noteworthy economic shift serves as a reminder of the link between the nation’s broader economic health and the daily lives of its citizens. For drivers, however, the message from the government is clear: the most effective way to save money on traffic fines is not through an inflation adjustment, but through safe, lawful, and responsible driving.
