Dominating this clandestine market is a single brand: Gold City. According to the Observatory’s analysis, this illegal brand alone accounts for approximately 30% of the total cigarette market in Costa Rica. It is openly sold on streets, at informal vendor stalls, and in small convenience stores, particularly in downtown San José and communities outside the Greater Metropolitan Area (GAM), making it a ubiquitous symbol of the thriving black market.

The logistical sophistication of this operation is immense, with a well-established supply chain stretching across the globe. Recent major seizures in Panama’s Colón Free Zone have confirmed that large shipments of Gold City and other illicit brands travel from Asia to the Panamanian port of Manzanillo. From there, the cigarettes are moved to warehouses that serve as regional distribution hubs, with Costa Rica being a primary final destination.

Beyond the staggering financial losses and links to organized crime, the contraband trade poses a severe public health crisis. These products evade all sanitary controls, meaning their contents are completely unknown and potentially more harmful than regulated tobacco. Furthermore, they are often sold for less than ¢1,000 per unit, directly undermining government policies aimed at discouraging smoking through taxation and price controls. The illegal practice of selling single cigarettes also makes them more accessible to minors and low-income individuals.

Distribution networks on the ground are notoriously difficult to dismantle. The sale of individual units complicates efforts to trace suppliers and allows micro-trafficking rings to expand with ease. Investigations have repeatedly shown that the same criminal structures involved in cigarette smuggling are also engaged in drug trafficking and other forms of contraband, using the profits from one illegal activity to finance another.

According to Carvajal, tackling this deeply entrenched problem requires a robust and coordinated inter-institutional response. He calls for joint operations involving Municipal Police, the Fiscal Control Police, and the Judicial Investigation Organism (OIJ). Strengthening controls along the border with Panama and rooting out corruption at customs posts, where a significant portion of the product enters the country, are also cited as critical priorities.

While the Legislative Assembly is currently debating new regulations for tobacco and vaping products, experts like Carvajal caution that simply increasing taxes or restrictions could have the perverse effect of making the black market even more attractive. Instead, he advocates for the rigorous application of existing laws, intensified enforcement at points of sale, and a dedicated focus on dismantling the high-level criminal organizations responsible for importing and distributing these illicit goods.
