The process had been stalled by a legal challenge from a competing bidder, International Container Terminal Services, Inc. (ICTSI). The company contested its disqualification from the tender, arguing it was improper, while also questioning the technical merits of the proposal submitted by the winning consortium. However, the Comptroller’s investigation found the disqualification to be justified and procedurally sound.
In its official resolution, the oversight body clarified the basis for its decision, focusing on a critical breach of the tender’s financial requirements by the appellant.
The Comptroller’s Office verified that the Administration was correct in excluding said offer, given that the financial debt level of the appealing company exceeds the maximum limit permitted by the tender rules. Thus, given its inability to win the contract, there is no merit in ruling on the remaining arguments, for which reason the appeal is rejected.
