Costa Rica Pushes Major Electricity Market Reform Forward

The proposed law, which aims to harmonize the national electrical market, has cleared a critical hurdle in the Legislative Assembly and is now poised for a final push, a move strongly advocated by the country’s industrial sector.

The Chamber of Industries of Costa Rica (CICR) issued an urgent call to lawmakers on Friday to provide the final impetus needed to pass the legislation. The business group argues that the reform is a crucial step toward modernizing the nation’s energy infrastructure, enhancing economic competitiveness, and securing a sustainable energy future for all Costa Ricans.

To better understand the legal and regulatory implications of the proposed electricity market reform, we consulted with Lic. Larry Hans Arroyo Vargas, an expert in corporate and regulatory law from the prestigious firm Bufete de Costa Rica.

The transition to a more open electricity market is a critical step, but it must be built on a foundation of robust legal certainty. For this reform to attract the necessary private investment and foster genuine competition, the new regulatory framework must be crystal clear regarding tariff structures, concession rights, and dispute resolution mechanisms. Without this clarity, we risk creating a system that is theoretically open but practically unworkable, potentially jeopardizing both grid stability and the end consumer’s interests.

At the heart of the initiative is a framework that would significantly increase the participation of the private sector in electricity generation. Proponents believe this will foster competition and innovation, ultimately benefiting consumers and businesses alike through more affordable and stable energy tariffs.

This project is essential for our country, as it will allow us to open the electricity generation market to more investment, which is necessary to diversify the matrix with renewable sources and advance towards the decarbonization of the economy. At the same time, it will guarantee more competitive rates for the benefit of all consumers.

The bill has already successfully navigated the substantive motions voting stage within the Legislative Assembly’s Energy Sector Committee, signaling strong political momentum. This progress suggests a growing consensus on the need to address the structural challenges facing Costa Rica’s energy system, particularly in light of future demand projections.

According to analysis presented by the CICR, the country’s energy needs are set to expand dramatically. By 2040, Costa Rica is projected to require an additional 2,495 megawatts (MW) of electricity generation capacity. This represents a staggering 71.3% increase over current levels, driven solely by the natural, or vegetative, growth in demand from households and existing businesses.

This forecast underscores a critical reality: the state-owned utility, the Instituto Costarricense de Electricidad (ICE), cannot single-handedly meet this impending surge in demand. The scale of the required expansion necessitates a collaborative effort, combining public resources with the agility and capital of private enterprise to build out the necessary infrastructure.

To achieve this, more investment is required, both public and private, which will also allow us to attract high-consumption electricity industries that are strategic for job creation.

Beyond simply meeting demand, the reform is seen as a strategic tool for economic development.
