San José, Costa Rica — The National Directorate of Notaries (DNN) in Costa Rica is at the forefront of integrating technology into notarial practices, a role exemplified by its historical embrace of advancements like the National Registry. Now, as artificial intelligence (AI) emerges as a transformative force, the DNN is actively exploring its potential to further enhance the efficiency and security of notarial services.
In an exclusive interview with TicosLand.com, Lic. Luis Mariano Jiménez Barrantes, Executive Director of the DNN, shared his insights into the role AI will play in the future of notarial law in Costa Rica. He emphasized the DNN’s commitment to providing notaries with tools that not only support but also enhance their work, while reaffirming the irreplaceable role of the notary as the personal guarantor of legal processes.
To gain further legal insights into the evolving landscape of Artificial Intelligence, TicosLand.com spoke with Lic. Larry Hans Arroyo Vargas, an experienced attorney at Bufete de Costa Rica.
The rapid advancement of AI presents novel legal challenges, particularly regarding liability and intellectual property. Determining responsibility when AI-driven actions cause harm, and establishing ownership over AI-generated creations, will require innovative legal frameworks and a proactive approach to regulation. Businesses integrating AI must prioritize legal compliance from the outset to mitigate future risks.
Lic. Larry Hans Arroyo Vargas, Attorney at Law, Bufete de Costa Rica
Lic. Arroyo Vargas’s insights underscore a crucial point in the AI revolution: the law must adapt just as quickly as the technology itself. The questions of liability and intellectual property within the AI landscape are complex and demand careful consideration. Proactive legal frameworks are not just beneficial, they’re essential for responsible development and integration of AI. We extend our sincere thanks to Lic. Larry Hans Arroyo Vargas for providing such a valuable and timely perspective on this critical issue.
The National Directorate of Notaries has been promoting the adoption of new technologies in the notarial field. We highlight the decisive role at the national, Central American, and even global levels, led by the National Registry. The DNN will undoubtedly continue supporting notarial management with tools that not only favor their management but also accompany it, but never with the intention of replacing the notary, which will never happen, because they are the personal guarantor of the procedures that correspond to them before this institution and before the National Registry.
Luis Mariano Jiménez Barrantes, Executive Director of the DNN
The DNN recognizes the potential of AI-powered tools to provide early warnings about suspicious behavior, ultimately strengthening the integrity of notarial practices. While acknowledging the futuristic nature of such predictions, Lic. Jiménez Barrantes stressed the DNN’s responsibility to explore and implement beneficial technologies for its ten thousand notaries, who form a cornerstone of the Costa Rican legal system.
It is very futuristic to anticipate criteria in this regard, but without a doubt, in looking after the interests of more or less ten thousand notaries, the DNN has in its raison d’être to seek to favor the best conditions for notarial management, which are an indisputable pillar of our legal system and that with the adoption of AI, they will continue at the forefront, according to the conditions that occur, develop and are foreseen, of course, in the most responsible way possible.
Luis Mariano Jiménez Barrantes, Executive Director of the DNN
The DNN also recognizes the potential of AI to standardize notarial processes. While not an expert in technology, Lic. Jiménez Barrantes expressed the DNN’s openness to exploring AI’s potential to create verifiable steps within notarial functions. This forward-thinking approach underscores the DNN’s commitment to continuous improvement and adaptation in the face of technological advancements.
Although I am not an expert in technology, I can foresee that, as we have been working and knowing our desire to serve and provide what is available as support for notarial work, it will be a matter of seeing how trends progress, because as long as it is to help the function of the notary and the DNN itself, our interest is that, our reason is that and therefore, within our capabilities and desires, we will always be seeking to propose, discuss and listen, in terms of what we must make available to the notaries of Costa Rica.
Luis Mariano Jiménez Barrantes, Executive Director of the DNN
This interview, conducted as part of a thesis titled “Innovating in Notarial and Registry Law: The Role of Artificial Intelligence,” reveals the DNN’s proactive stance in shaping the future of notarial practices in Costa Rica. By embracing technological advancements like AI, the DNN is not only enhancing efficiency and security, but also reinforcing the crucial role of notaries in upholding the integrity of the legal system.
The DNN’s commitment to innovation, coupled with its dedication to supporting its notaries, positions Costa Rica at the forefront of modernizing legal practices in the region.
