Japdeva Plunged into Crisis as Criminal Complaint Targets Employee Fund

Limón, Costa RicaLIMÓN – The Port Administration and Economic Development Board of the Atlantic Slope (Japdeva) is facing a significant crisis after its executive president, Sussy Wing, filed a criminal complaint on Wednesday following the discovery of severe irregularities within the employees’ Capital and Savings Fund. The move has prompted the immediate suspension of two union leaders and the fund’s administrator, signaling a deep-seated problem that could have legal and financial repercussions for years to come.

The drastic measures were triggered by a special external audit conducted by the firm Murillo & Asociados, S. A. The Japdeva board of directors commissioned the investigation due to long-standing suspicions surrounding the management of the fund, which was operated by the institution’s workers’ union. The audit provided a thorough financial and operational review covering the period from 2020 through October 2025.

In a decisive statement, Executive President Sussy Wing confirmed her actions and the gravity of the situation. She personally presented the findings to the authorities to ensure accountability and protect the financial interests of the fund’s members, both past and present.

Today, in my capacity as executive president of Japdeva, I appeared before the Probity Prosecutor’s Office to file a complaint. This is due to the results of the special audit conducted on the savings fund, for alleged irregularities that can be classified as criminal offenses, seeking to safeguard the interests of the current and former members of the aforementioned savings fund.

The board of directors acted swiftly on the audit’s findings. As a precautionary measure, the fund’s administrator was suspended from her duties with pay. The same action was taken against Antonio Wells Medina, secretary of the Japdeva workers’ union, and another union official, Rohan Ramírez Davis, pending the outcome of the official investigation.

The audit report from Murillo & Asociados, S. A. uncovered a host of troubling practices. Investigators examined credit recovery policies, contracts, promissory notes, and monetary transactions. An immediate red flag was the state of the loan application ledgers, which were reportedly marred by erasures and cross-outs. The auditors noted that this “generates doubts about the legitimacy of the information and complicates its use for assigning loans to officials who meet all the requirements.”

However, the most alarming discovery dates back over a decade. The audit revealed that as of November 30, 2010, the Mutuality Fund had a balance of ¢134 million recorded in its books. This amount was not physically held in a bank account but had instead been absorbed and used as working capital for the financial operations of the Capital and Savings Fund, a move that raises serious questions about financial controls and the proper use of employee assets.

The auditors’ final assessment was stark, questioning the very viability of the fund. “Based on the going-concern elements related to legality that may affect the business’s continuity and those legal risks or situations that cast doubt on the fund’s ability to continue operating in the future, it is necessary to evaluate the operational, administrative, and financial continuity of the fund,” the report concluded.

In response to this grave warning and the litany of irregularities, the Japdeva board has authorized the complete liquidation of the Capital and Savings Fund. An Institutional Fund Liquidation Commission has been appointed to oversee the complex process of winding down its operations and ensuring that the remaining assets are handled appropriately. The future of the employees’ savings now rests in the hands of this commission and the unfolding criminal investigation.
