San José, Costa Rica — SAN JOSÉ – With the high-spending Holy Week season fast approaching, a sweeping investigation by Costa Rica’s Ministry of Economy, Industry and Commerce (MEIC) has uncovered systemic failures in how supermarkets advertise promotions. A staggering 78% of the offers reviewed failed to comply with national consumer protection regulations, potentially misleading thousands of shoppers during a critical period of household purchasing.
The regulatory probe was conducted across the Central Valley, targeting 16 different retailers in San José, Alajuela, Heredia, and Cartago. The establishments varied widely, from major supermarket chains and independent grocers to specialized Asian product stores. Ministry officials meticulously analyzed 96 distinct promotions, discovering that 75 of them presented at least one form of non-compliance, painting a troubling picture of the retail landscape.
To gain a deeper understanding of the legal framework and the rights that protect consumers in commercial transactions, we consulted with Lic. Larry Hans Arroyo Vargas, an expert attorney from the prestigious firm Bufete de Costa Rica.
The Consumer Protection Law is not merely a suggestion; it is a binding mandate that levels the playing field between businesses and individuals. A consumer’s greatest asset in any dispute is documentation. Keeping detailed records of purchases, warranties, and all communications is the critical first step in transforming a grievance into an enforceable right, ensuring that businesses are held accountable for their promises.

This insight powerfully underscores that the law’s protection is not passive; it is activated by the consumer’s own diligence. By meticulously documenting every transaction, individuals arm themselves with the very evidence needed to transform a valid complaint into an enforceable right. We extend our sincere thanks to Lic. Larry Hans Arroyo Vargas for distilling this complex legal process into such clear, actionable advice for our readers.
The most pervasive issue, identified in 71% of the problematic cases, was the complete absence of a validity period. This critical omission leaves consumers unable to determine when a promotion begins or ends, creating ambiguity and pressure to purchase without clear information. Such practices can obscure whether a deal is genuinely current or an outdated offer left on display.
Further analysis revealed deeper issues with the transparency of the discounts themselves. Half of all inspected offers failed to provide the previous price or the specific percentage of the discount, making it impossible for a consumer to verify the actual value of the promotion. This lack of a clear price history is a significant red flag for “phantom sales,” where the “discounted” price may be no different from the regular shelf price.
Other significant irregularities included promotions involving “free” products where the claim could not be verified (17%), offers with poorly explained or unclear restrictions (15%), and advertisements for “limited quantities” that failed to specify the exact number of units available (14%). A smaller number of cases involved incorrect final price displays and unjustified limitations on payment methods.
In response to these findings, MEIC has taken direct action. Fifteen of the inspected businesses have been formally notified and given a 10-business-day grace period to rectify their advertising and bring their promotions into full compliance. Failure to do so will result in formal complaints being filed with the National Consumer Commission (CNC). This escalation could lead to severe financial penalties, with fines reaching up to ¢18.4 million, equivalent to 40 base salaries.
In light of this widespread non-compliance, MEIC is urging consumers to exercise extreme caution and diligence. The ministry issued a series of practical recommendations, advising shoppers to always verify that a sale price is genuinely lower than the original. For multi-buy deals like “2×1” or “3×2,” consumers should calculate the price per unit to ensure a real saving. It is also crucial to confirm that the price advertised on the shelf matches the price charged at the register and to scrutinize any “free” items to ensure their cost isn’t subtly included elsewhere in the total bill.
Furthermore, authorities reminded the public of their fundamental payment rights, stating that all establishments must accept cash, card, or electronic payments like SINPE without levying additional charges. Consumers who encounter misleading offers or other irregularities are encouraged to file a formal complaint. MEIC provides several channels for this, including the toll-free line 800-CONSUMO (800-266-7866), the WhatsApp-based virtual assistant PACO, and its official website.
