With the legal hurdles resolved, the Instituto Costarricense de Puertos del Pacífico (INCOP) is now authorized to proceed with the public bidding process and finalize the contract with Consorcio Sunset. The consortium was initially awarded the development rights, but the signing had been frozen due to formal objections filed by competing bidders.
The primary challenge arose from International Container Terminal Services, Inc. (ICTSI), which contested its disqualification from the tender. The firm had formally questioned the technical suitability of Consorcio Sunset’s winning proposal. However, the Comptroller’s ruling definitively dismissed these claims, validating the integrity of the selection process and allowing the administration to move forward.
